1. Important Notice & Binding Agreement
PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE CHINGUVERSE companion SOFTWARE APPLICATION (THE "SOFTWARE").
BY CLICKING "I AGREE", DOWNLOADING THE INSTALLER, OR RUNNING THE SOFTWARE ON YOUR WINDOWS OPERATING SYSTEM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA BETWEEN YOU (AN INDIVIDUAL OR A SINGLE LEGAL ENTITY) AND LASANTHA PRADEEP ("LICENSOR"). IF YOU DO NOT AGREE, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.
2. Grant of License
Subject to the terms and conditions of this EULA, Licensor grants you a personal, non-exclusive, non-transferable, revocable license to:
- Download, install, and execute the Software in object code form on personal computers running compatible 64-bit Windows operating systems that you own or control.
- Use the Software strictly for your personal, non-commercial entertainment and desktop productivity enhancement purposes.
3. Restrictions on Use
Except as expressly permitted by this EULA or by applicable law, you shall not:
- Reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code or proprietary animation vectors of the Software.
- Modify, adapt, translate, enhance, or create derivative works based on the Software or character designs (Mochi-Chan, Mochi-Kai, Mochi-Ko, Bit Cyber Dog, Chip Cyber Bunny).
- Rent, lease, lend, sell, sublicense, distribute, or commercially host the Software as a service bureau or cloud gaming bundle.
- Remove, alter, or obscure any proprietary copyright, trademark, or watermark notices embedded within the Software or its assets.
4. Intellectual Property & Character Ownership
The Software is licensed, not sold. All rights, title, and interest in and to the Software—including but not limited to character designs, visual artwork, storylines, synthetic audio files, animations, user interface design, and underlying code—remain the sole and exclusive property of Licensor.
This EULA does not grant you any ownership rights or title in the Software or its intellectual property.
5. Updates & Future Character Releases
Licensor may from time to time provide software updates, patches, bug fixes, or new character modules. Updates are delivered through the Microsoft Store.
This EULA will govern any updates provided by Licensor, unless such update is accompanied by a separate updated license agreement.
6. Offline Architecture & Local Storage Notice
The Software operates locally and offline on your computer. You acknowledge and agree that your local notes, custom schedules, and pet experience scores are stored locally in your Windows user directory. You are solely responsible for maintaining local backups of your system files.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, COMPUTER FAILURE, OR WORK INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED.
9. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Licensor if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete all copies from your computers.
