1. Agreement to Terms
By accessing or using the website located at https://chinguverse.com (the "Website") or downloading promotional materials and preview builds of the ChinguVerse companion software, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all provisions within these Terms, you must immediately discontinue using the Website and delete any downloaded materials.
2. Intellectual Property Rights
Unless otherwise explicitly stated, the Website, its entire contents, features, functionality, visual design, custom logos, character designs (including Mochi-Chan, Mochi-Kai, Mochi-Ko, Bit Cyber Dog, and Chip Cyber Bunny), vector artwork, audio synthesizers, code, and promotional media are the exclusive intellectual property of Lasantha Pradeep and are protected by applicable copyright and other intellectual property laws.
You are granted a personal, non-exclusive, non-transferable, revocable license to access the Website and review promotional assets for personal, non-commercial evaluation purposes. You may not duplicate, redistribute, sublicense, or commercially exploit any proprietary character artwork or branding without express written authorization.
3. Software Downloads & License Grant
Any software application or installer provided through the Website is licensed, not sold. Your installation and ongoing usage of the desktop application is governed by my separate End User License Agreement (EULA), which supplements these Terms. In the event of a conflict between these Terms and the EULA with respect to desktop software usage, the EULA shall prevail. Product availability, features, and pricing may change as the project develops.
4. Acceptable Use Policy
When using my Website and services, you agree not to:
- Use the Website in any manner that could disable, overburden, damage, or impair my hosting infrastructure (such as denial-of-service attacks).
- Use any automated robot, spider, crawler, or scraper to harvest data, text, or character artwork from the Website without permission.
- Attempt to gain unauthorized access to my hosting account, computer systems, or server networks.
- Misrepresent yourself as affiliated with, sponsored by, or endorsed by ChinguVerse.
5. Website Data and Privacy
The Website does not require an account or collect information through forms, newsletters, user profiles, cookies, browser storage, analytics, advertising pixels, or behavioral tracking. Technical information processed by the hosting provider to deliver and protect web requests is governed by that provider's policies. The desktop application may save your settings, notes, schedules, and progress locally on your Windows computer. That local application data is not a Website account and is not uploaded to me by the Website.
6. Third-Party Links & Services
The Website may link to external services, including the Microsoft Store, Facebook, YouTube, X, GitHub, Discord, and the developer's personal website. I have no control over the content, privacy policies, tracking, or practices of those services. Your use of an external service is subject to its own terms and privacy policy.
7. Disclaimer of Warranties
THE WEBSITE AND PREVIEW DOWNLOADS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE WEBSITE OR SOFTWARE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

To the maximum extent permitted by applicable law, in no event shall Lasantha Pradeep be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages—including damages for loss of profits, goodwill, data, or business disruption—arising out of or in connection with your use or inability to use the Website or downloaded materials.

These Terms shall be governed by the laws that apply in the jurisdiction where I reside, without regard to conflict of law principles. Nothing in these Terms limits any rights that cannot legally be waived.
